Yvonne graduated from the University of Hong Kong in 2011 with an LLB degree and her Postgraduate Certificate in Law. She joined Oldham Li & Nie as a trainee in November 2011, where she specialised at the firm’s Matrimonial and Family Law Department. After her training at Oldham Li & Nie, she qualified as a solicitor in November 2013 and joined the firm’s Matrimonial and Family Law Department as an Associate. She was promoted to Senior Associate in 1st January 2019 and became a Partner at OLN’s Matrimonial and Family Law Department in 1st December 2020.

Yvonne has worked extensively with local and expatriate clients on applications for divorce, financial applications and children matters. Yvonne thrives and has a particular strong interest in complex children applications including Hague Convention, Wardship, surrogacy, adoption, relocation, custody, care and control and access. She has extensive experience attending and advising clients at mediation, hearings and high conflict trials where she works frequently with experienced Counsel. Yvonne also has experience with helping clients obtain adoption orders, maintenance orders for children born out of wedlock, applications for interim financial orders against deceased persons’ Estates and Committee Orders under Part II of the Mental Health Ordinance (Cap.136).

Yvonne has solid experience in ancillary relief matters throughout her years at OLN, advising high net worth clients on their division of assets as well as pre-nuptial and post nuptial agreements. She has substantial experience in working on local and overseas probate and trust matters and advises clients on their Wills and on estate planning and administration of estates.

  • Acting for the liquidator and provisional liquidator in over 40 highly-contested winding up proceedings as part of a global insolvency and restructuring process of a multi-national fish trading conglomerate with worldwide operations and entities listed in HK and Singapore.

Dantes Leung specialises in commercial litigation, international arbitration and contentious regulatory matters. He has extensive experience in advising and representing multinational corporations and high-net-worth individuals in a wide range of cross-border commercial disputes, such as international contractual disputes, joint venture and shareholder disputes, probate and trust disputes, intellectual property disputes, fraud and debt recovery. He also has substantial experience in dealing with various regulators such as the Securities and Futures Commission, the Independent Commission Against Corruption and the Trade and Industry Department.

Dantes is accredited as a Solicitor Advocate in respect of civil proceedings by the High Rights Assessment Board appointed by the Chief Justice of Hong Kong. As such, he is one of 100 solicitors who have rights of audience before the Court of Final Appeal in Hong Kong.

Jonathan is a Partner at Oldham, Li & Nie. He regularly acts on commercial dispute matters involving multi-national corporations and has cross border elements.

Apart from his extensive experience in dispute resolution practice, Jonathan is also experienced in trust and probate matters.

COMMERCIAL LITIGATION EXPERIENCE

  • Acting in a debt recovery action against the borrower and the various securities providers. The collaterals involved include a share charge over a holding company of a hotel project of sizeable value. Claim sum is US$83 million. Successfully obtained Summary Judgment and subsequent enforcement actions including appointment of receiver, examination of judgment debtor and winding up actions. Successfully resisted appeals.
  • Acting for a Cayman investment fund in insolvency proceedings, liaising and handling Cayman counsel for a related insolvency action. Acting for the same defendant in an arbitration proceedings in Hong Kong and defending against a Mareva and proprietary injunction in aid of arbitration.
  • Shareholders dispute in relation to beneficial title of shares in a PRC Company that is worth US$25 million. Succeeded in defending against stay application by the Defendants at Court of Appeal.
  • Derivative action of a minority shareholder in a HK company for having misappropriated the Company’s fund via various suspicious transactions which were not recorded in the Company’s Audited Report. Claim amount is about HK$7 million. Succeeded in defending strike out application by the Defendants. Succeeded in obtaining Wallersteiner costs order against the Company.
  • Cases involving injunctions, including injunctions in shareholders’ disputes, fraud cases and internet scams. Successfully obtained Mareva Injunction Orders protecting assets of clients.
  • Acting for a Third Party in an Injunction Action where the Third Party is the lender of money to the Defendant. The security being publicly traded shares which were frozen by the Plaintiff which are under Defendant’s control pursuant to an agreement.
  • Acting and advising in various civil and commercial dispute matters including disputes regarding trademark infringement, sale and purchase of properties and breach of agreements.

ESTATE PLANNING, TRUST AND PROBATE EXPERIENCE

  • Representing the administrator of the estate of a high profile individual with a diverse portfolio of assets in multiple jurisdictions

Profile

Victor joined OLN in 2013 and was admitted as a solicitor in 2015. Apart from being a Hong Kong qualified lawyer, he is also a member of the Hong Kong Institute of Certified Public Accountants. Prior to commencing his legal career, Victor worked in two of the “Big Four” accounting firms focusing on Hong Kong, international and PRC taxes.

Riding on his dual-qualification which is quite unique in the legal industry, Victor not only assists clients on a broad range of cross-border corporate and commercial transactions (including M&As, due diligence, foreign direct investments in the PRC) and general commercial matters (including employment matters, data privacy and commercial agreements), but also advises clients on international tax planning matters with a focus on transactions and investment involving Hong Kong, PRC and the EU (including permanent establishment and tax treaty issues). Specifically, many of Victor’s clients are in the F&B industry and entertainment industry.

Victor’s clients include multi-national corporations having business presence in various jurisdictions and many startup entrepreneurs.

TAX ADVISORY EXPERIENCE

  • Provided advice to the luxury hotel group trading under the brand name of “Pavilions” on its aggressive expansion plan in 2015 which included the acquisition and development of lands and hotels in in Amsterdam, Madrid, Portugal, Niseko and Nepal
  • Advised a cosmetics group which conducted sales in multinational markets including France and Japan on an optimal holding structure in light of its forthcoming changes of the tax residency of the ultimate individual shareholders
  • Assisted a client to lodge a formal objection to the Inland Revenue Department against the taxability of the interest income and foreign exchange gain which were not Hong Kong sourced
  • Assisted the client, who is appointed as the Property and Affairs Deputy of an individual by the Court for the individual’s benefit, to consider the law in relation to the guardianship of the individual as well as the tax issues concerning the assets of the individual
  • Successfully assisted a charitable organization in Hong Kong to liaise with the Inland Revenue Department and maintain the section 88 status
  • Assisted a high net worth individual with his personal tax planning, including considering various options available to the client as well as setting up a trust for him and his family members
  • Successfully assisted clients to lodge a claim with the Inland Revenue Department with respect to the tax treatments regarding the ex-gratia payment, statutory severance payment and relocation allowance paid to clients that the termination compensation was not subject to Hong Kong Salaries Tax based on various case laws
