Nicky Tse is a solicitor, notary public and China-appointed Attesting Officer in Hong Kong specializing in litigation, alternative dispute resolution (ADR) and corporate and commercial matters.

For contentious matters, Nicky works regularly with a team of Counsel and Senior Counsel with various specialties in arbitration tribunals and all levels of Courts. During his past decade of practice, Nicky handled shareholders and boardroom disputes, insolvency, land, land compulsory sale, probate, trust, matrimonial, medical-related, construction, election and administrative matters, and very urgent Court applications for interlocutory relief including injunctions, appointment of provisional liquidators and NPOs.

For commercial matters, Nicky regularly advises cross-border corporations ranging from aviation, international trade, F&B and entertainment industries, including M&A deals, restructuring, banking and other company matters.

Nicky regularly advises on a wide range of land and real estate matters including high value conveyancing, as well as advising on town planning applications, tenancy matters (for landlords and tenants) and acting for investors in negotiating land acquisitions and land redevelopment in Hong Kong. On contentious land and real estate matters, he acted for clients on land related disputes including tenancy (for landlords and tenants), vendor and purchaser summonses, adverse possession claims and defence, town planning related judicial reviews and compulsory land sales disputes.

He also acts on behalf of law enforcement investigations including the Police (including the Commercial Crime Bureau), the Securities and Futures Commission, the ICAC, Labour Department, Immigration Department and Customs and Excise Department.

Nicky joined Oldham, Li & Nie in 2021 as Consultant Solicitor. Before that, he served as a litigation associate in Yung, Yu, Yuen & Co., then Hoosenally and Neo as Consultant Solicitor, where he established his own practice.

In September 2020, Nicky was appointed as a notary public by the Chief Judge of the Hong Kong High Court.

In May 2021, Nicky was appointed as a Civil Celebrant of Marriages by the Registrar of Marriages, Hong Kong.

In May 2023, Nicky was appointed as a China-Appointed Attesting Officer by the Ministry of Justice, People’s Republic of China (Nicky Tse – CAAO qualification).

Nicky is a CPD legal course speaker delivering seminars on election law and land compulsory sale. He is a panel solicitor with the Legal Aid Department, and provides at least 100 hours of pro bono legal services every year to the community and those in need.

Nicky served the Hong Kong Taekwondo national team and achieved Black Belt 5th dan in Taekwondo. He also practiced ISSF air-pistol and air-rifle shooting.

  • Advised a SFC licensed securities firm in relation to exemptions under section 103 of Securities and Futures Ordinance (Cap. 571)
  • Advised a leading PRC Gaming Listco on Non-Compete and Confidentiality Agreement under the Hong Kong Law Context

ARBITRATION AND LITIGATION

  • Successfully obtained injunction and recovered 100% funds plus legal costs for email scam victims, relying on section 38A of the District Court Ordinance (equivalent to section 25A of the High Court Ordinance (Case No.: DCCJ 5820/2021, [2022] HKDC 369)
  • Successfully resisted a group of developers’ application at the Lands Tribunal for extending the validity of a compulsory order for sale after a failed auction with Counsel Johnathan Tsang Esq. with costs (Case No. LDCS 14000/2017)
  • Acting for Hong Kong Express Airways Limited with Counsel Lawrence Cheung Esq. in a Labour Tribunal appeal and successfully appeal against the Labour Tribunal Decision on the legality of suspending an employee pending investigation with costs (Case No.: HCLA 29/2018, [2021] HKCFI 1333)
  • Acted for a foreign manufacturing packaging company with Counsel Teresa Leung Esq. to conduct fund tracing, and successfully obtained both civil and criminal injunction for preserving the lost funds and through Hong Kong Police, and obtained final judgment with costs. (Case No.: DCCJ 5849/2020, [2021] HKDC 297)

CRIMINAL DEFENSE

  • Successfully appeal against conviction with Senior Counsel John Reading Esq., Counsel Kelvin Li Esq. and Counsel Gilbert Chong Esq. for a dentist who was charged with one count of fraud on Community Care Fund Elderly Dental Assistance Programme: HCMA 262/2021, [2023] HKCFI 458. Press coverage.
  • Successfully secured a release of an agent charged with 36 counts of supplying face masks to the Hong Kong Government Logistics Department to which false trade description had been applied at a sum of HK$97,748,000 (DCCC 890/2021). Press coverage.
  • Advised various employees of a multi-national company in a large-scale Department of Health investigation pursuant to Prevention and Control of Disease Ordinance (Cap. 599) and its regulations with Senior Counsel Eric Kwok Esq. and Counsel Albert Chan Esq. and secured that a complete discharge after investigation.

Amy Cheung specialises in commercial litigation, arbitration and contentious regulatory matters. She has extensive experience in advising and representing corporations and high-net-worth individuals, with a particular focus on representing Hong Kong listed companies in a wide range of cross-border commercial disputes, such as contractual disputes, commercial fraud and asset tracing, breach of directors’ fiduciary duties, shareholders disputes and property and probate disputes. She also has substantial experience in dealing with various regulators such as the Securities and Futures Commission and the Independent Commission Against Corruption.

Amy also has extensive experience handling debt restructuring and security enforcement including advising on schemes of arrangements in Hong Kong and in other offshore jurisdictions.

Paul E. Firmin

Paul qualified as a solicitor in the United Kingdom in 1979 and worked in private practice in Manchester before moving to Hong Kong in 1987. Paul then worked for a large local solicitors’ firm in Hong Kong for 12 years, eventually becoming the partner in charge of the firm’s litigation department.

In 1999 Paul moved to Queensland, Australia where he practised for two years with a leading Brisbane firm before returning to Hong Kong in January 2002 to join OLN.

Paul works primarily in OLN’s Matrimonial and Family Law Department, but also continues to handle other private law cases, along with compliance and regulatory matters from time to time.

Paul is a Civil Celebrant of Marriages and a member of the Hong Kong Family Law Association.

For many years Paul sat as Chairman of a number of Solicitors’ Disciplinary Tribunals, and since 2011, Paul has been appointed to the panel of Chairmen for the Building Ordinance (Cap 123) Appeal Tribunal.

Paul has been a part-time tutor at Hong Kong University, tutoring on the Postgraduate Certificate in Laws for the past 15 years.

Evelyne is senior associate serving in the firm’s Intellectual Property Department. She was admitted as solicitor in Hong Kong in 2005 and joined us in 2013.

She has extensive experience on intellectual property matters including non-contentious matters, likes prosecution of trade marks (including collective trade mark, certification trade mark and defensive trade mark), designs and patent matters in Hong Kong, China and worldwide.  She also handles contentious intellectual properties matters, likes trade mark opposition, revocation and declaration of invalidation.
